GENERAL RELEASE AND WAIVER OF LIABILITY FORM

To be completed by each kickball participant, no matter how many games you plan to play.

For good and valuable consideration, receipt of which is hereby acknowledged, I hereby release and hold harmless ROC Ventures, LLC / Kokomo Baseball, LLC dba Kokomo Jackrabbits / City of Kokomo / Northwoods League, Inc. / Jackrabbits Kickball League and its Member Teams, and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents (the “Kickball Parties”) from and against any and all claims, causes of action, or demands relating to or arising out of my performance for the ROC Ventures, LLC / Kokomo Baseball, LLC dba Kokomo Jackrabbits to take place at Kokomo Municipal Stadium (located at 400 Union Street, Kokomo, IN 46901) on the following date(s): September 20, 2021 to November 15, 2021 (the “Performance”), and further agree to indemnify the Kickball Parties for any claims, damages or causes of action relating to or arising out of the Performance.

I expressly assume all risk of injury (including, without limitation, permanent disability and death) relating to or arising out of the Performance, howsoever caused or arising and whether by all acts of negligence or otherwise, and accept personal responsibility for the damages following such injury, permanent disability or death; however, this agreement shall not waive liability for intentional or grossly negligent acts committed by Kickball Parties.

I RECOGNIZE THERE ARE INHERENT DANGERS ASSOCIATED WITH THE PERFORMANCE (INCLUDING BUT NOT LIMITED TO RUNNING, JUMPING, DANCING, STUNTS, GYMNASTICS, ATHLETIC ACTIVITIES, BASEBALL RELATED ACTIVITIES, AND OTHER CARDIOVASCULAR ACTIVITIES) TO WHICH I MAY BE EXPOSED AND I HEREBY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE PERFORMANCES.

I certify that I am in good health and have no physical impairment, injury, or illness that will make my participation dangerous to myself or others.

I release Kickball Parties from liability for any damage that I may suffer, even if that damage is caused by Kickball Parties’ negligent acts or omissions.

I grant full permission to the Kickball Parties, by any means, whether now known or hereinafter developed, to exhibit, record, reproduce, broadcast, transmit, publish, sell, distribute, perform, use and re-use, and to license others to exhibit, record, reproduce, broadcast, transmit, publish, sell, distribute, perform, use and re-use, for any purpose, in any manner, without further notification, authorization or compensation to me or anyone on my behalf, my name and likeness, and any photographs, videotapes, motion pictures, recordings, or other record of the Performance (or any part or parts of my Performance) in any and all media, whether now known or hereafter developed, worldwide and in perpetuity, and I represent and warrant that no further permission is required for the Kickball Parties to use the Performance as provided herein.

I ACKNOWLEDGE THAT METAL CLEATS OR SPIKES, SUNFLOWER SEEDS, AND GUM ARE NOT PERMITTED IN THE STADIUM OR ON THE FIELD OF PLAY. IF I VIOLATE THIS, I WILL BE ASKED TO LEAVE THE FIELD OR STADIUM.

I further represent and warrant that: (i) I have the right to conduct the Performance and that the Performance will not reflect badly on the Kickball Parties, and (ii) I have full authority to execute this General Release and do so with full knowledge of the facts and circumstances surrounding the Performance and the rights that I am granting herein.

I acknowledge that I have read and fully understand the foregoing.
