Electronic 50/50 Raffle Official Rules of Play
OFFICIAL RULES: By participating, entrants agree to be bound by these Official Rules and by the decisions of The Larks Community Fund ( “LCF”) which shall be binding and final as to all matters related to the LCF 50/50 Raffle (the “Raffle”). The Raffle is subject to all applicable federal, state, and local laws. NET PROCEEDS: All net proceeds of the Raffle will benefit The Larks Community Fund (hereafter known as the “Sponsor”) and the programs and charitable donations that the Sponsor supports. PRIZE(S): The winner of each 50/50 Raffle will receive a cash prize equal to fifty percent (50%) of total gross revenue received during that raffle with a maximum allowable payout of $25,000.00. All raffles conclude the same day the ticket is purchased. ELIGIBILITY TO ENTER: Prizes for each raffle consist of 50% of the total gross proceeds. Tickets must be purchased in person at Bismarck Municipal Ballpark. Participants must be 18 years or older and otherwise meet the conditions specified in these Official Rules of Play and are required to present a valid driver’s license or state ID at the time of purchase and prize redemption. Winners need not be present to win and have 5 days from the date of drawing to present their legible ticket showing the winning raffle number. The following individuals are ineligible to participate in a Raffle: Those directly affiliated with the administration of the raffle and selecting its winners; and their immediate family members and Executives and Employees of Tap 50:50 Event Consultants
RAFFLE DETAILS: Tickets will only be sold in person at the Bismarck Municipal Ballpark in Bismarck, North Dakota. Ticket sales will commence (1) hour before the first pitch of each Larks Baseball home game and sales will run until the end of the 5th Inning. All ticket sales will conclude at the end of the 5th inning and a winning ticket number will be drawn and announced no later than the end of the 6th inning. In the event of the home game being cancelled, there will be no ticket sales for that date. Winners who present a winning ticket number immediately after the raffle will be paid the same day. The following prices and corresponding “ticket numbers” are available for purchase: Ticket prices are 1 for $5.00 – 10 for $10.00 – 40 for $20 .00 – 100 for $40.00
DRAW DATES: All dates and times for raffles are in conjunction with the Bismarck Larks Baseball regular home game schedule. Please see the Larks Baseball website the full season schedule of game dates and start times. https://northwoodsleague.com/bismarck-larks/ DRAW SELECTION: At the conclusion of each Raffle period, the winning number(s) will be selected using a Random Number Generator (“RNG”) system from all eligible ticket numbers for that raffle. The drawings will take place at Bismarck Municipal Ballpark, 303 W. Front Ave, Bismarck, ND 58504. The winning number will be announced multiple times over the PA System and via Video Board projection no later than the end of the 6th inning. The participant with the winning number is responsible to present a valid ID acknowledging they are 18 years of age or older and to present a legible winning ticket. In the event no winner comes forward on the day of the raffle, all winning numbers will be posted on the website and winners will have 5 days to claim their prize after every raffle. https://northwoodsleague.com/bismarck-larks/community/50-50-raffle-winners/ DETERMINATION OF OFFICIAL WINNER(S): It is The Larks Community Fund’s sole discretion to determine whether each Potential Winner is an official winner of a Prize (an “Official Winner”). The decision concerning the identity of all Official Winners shall be final and binding. To become an Official Winner: (1) a Potential Winner must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in by the Sponsor’s sole judgment; (2) that Potential Winner must initiate the Claim Process by the deadline specified above. AWARDING OF PRIZE(S) TO OFFICIAL WINNER(S): A Prize will be awarded to each Potential Winner who has been designated by the Sponsor as an Official Winner. If after the ample allotted time and multiple announcements, if No Winning Ticket Number is presented, per (N.D.A.C. § 99-01.3-05.1-03(4)) a raffle winner has (5) days to claim the prize (https://northwoodsleague.com/bismarck-larks/community/50-50-raffle-winners) and if they do not claim their prize within the 5 business days the ND State Gaming Director is to be contacted for instructions on next steps. In rare and anomalous event of a winning ticket number having more than one winner, the sponsor shall award the prize to the first individual to present the ticket to an authorized raffle attendant within the allotted claim window(s). The Larks Community Fund is not responsible for resolving any disputes which may arise between different individuals who may or may not have duplicated winning raffle ticket numbers. GENERAL CONDITIONS: The Released Parties (defined below under “RELEASE OF LIABILITY”) are not responsible for: (1) Entries which are stolen, lost, damaged, illegible, given away or no longer in the purchaser’s possession, (2) Entries that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) Entries or payments that are delayed, misdirected, undelivered, not fully captured, or garbled as a result of any failure or problem whatsoever with the availability, functionality, operability or use of any network, server, ISP, website, computer, telephone, cable or satellite modem or connection, hand held mobile device or any other computer equipment or connection, whether or not caused by site users, tampering, hacking, or by viruses, worms, or malfunctions affecting a network, server ISP or any equipment or programming used in or associated with the Raffle; (4) any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the Raffle (collectively, as described in clauses (1) through (4), “Errors”), including without limitation Errors in Raffle-related materials or in the administration of the Raffle, such as Errors in processing Entries, identifying Potential Winners, determining Official Winners, or announcing or delivering Prizes; or if any portion of the Raffle is compromised, in Sponsor’s sole judgment, by a virus, worm, bug, non-authorized human intervention or other causes which, in Sponsor’s sole judgment, corrupt or impair the administration, security, fairness or proper play of the Raffle, or the proper submission or capture of Entries (collectively, a “Compromising Event”), then Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Raffle, and to select winners from all eligible, non-suspect Entries received before the known occurrence or discovery of such Comprising Event. All ticket sales are final. No refunds or exchanges will be issued. By purchasing a ticket, the entrant acknowledges that a raffle is a form of gaming and involves an inherent risk of loss. The Sponsor (Larks Community Fund) and The Bismarck Larks make no guarantees regarding the odds of winning or the value of prizes beyond their stated description. No replacement tickets will be printed or issued by Sponsor, no exceptions. Sponsor has sole and final decision on admissibility of entries and the determination of prize winner. RELEASE OF LIABILITY: Entrants, by participating in the Raffle, agree that The Sponsor, (aka The Larks Community Fund), The Bismarck Larks and Tap 50:50, each of their respective parents, affiliates, subsidiaries, partners, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, shareholders, members, consultants and agents (collectively, the “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for injuries, losses, cost, expenses or damages of any kind, including damages for death, personal injury, property damage.
